Terms of Service

By accessing or using the Paydar platform (mobile, web, or related services), you agree to these Terms of Service. If you do not agree, you may not use the Services.

Paydar is a digital marketplace that enables college athletes and local businesses to discover, manage, and execute Name, Image, and Likeness (“NIL”) opportunities through AI-powered tools, messaging, contract analysis, and payment processing. All negotiations and fulfillment occur exclusively between athletes and businesses — Paydar is not a party to these agreements.

Please review these comprehensive Terms below. Use of Paydar must comply with all applicable NCAA, conference, state NIL regulations, institutional policies, and the law. If you have questions or concerns, contact us at contact@gopaydar.com.

1. Eligibility & Parental Consent

You must be at least 13 years old to use Paydar. Users aged 13–17 must have verified parental consent, with parents overseeing account and contract activity. Children under 13 are not allowed. Paydar relies on user-reported compliance.

2. Description of Services & Platform Role

Paydar is a self-service technology platform for NIL deals—providing AI tools and secure payments, but not serving as a law firm, agent, broker, or contracting party. All contracts occur directly between users. Using Paydar does not create a legal agency or attorney-client relationship.

3. Deal Funding & Platform Fees (Summary)

Each deal must be pre-funded by businesses via Stripe before posting and funds are held until deliverables are approved or disputes resolved. Paydar charges a 15% fee on funded deals, deducted before athletes receive net compensation. Refunds are generally available only before deal acceptance, limited or unavailable after.

4. Payments

All Paydar payments are securely processed by Stripe Connect. Using Paydar requires you to agree to Stripe’s terms, including submitting identity verification information. Paydar does not access or store your full bank or card details. Please ensure that your compliance information is up-to-date to prevent payout delays.

5. Subscriptions, Automatic Renewal, Cancellation, and Refunds

5.1 Subscription Plans and Billing. Paydar offers subscription plans and premium features to eligible athlete and business users. Certain features may require a paid subscription, with pricing, billing frequency, subscription duration, and applicable terms disclosed before purchase. Subscriptions purchased through the Apple App Store are billed and managed by Apple under the applicable Apple account and payment terms. By purchasing a subscription, you authorize the applicable recurring charges through Apple and acknowledge that your subscription will automatically renew unless canceled before the next renewal.

5.2 Automatic Renewal. Unless otherwise disclosed at the time of purchase, paid subscriptions automatically renew for successive billing periods of the same duration at the then-applicable subscription price, plus any applicable taxes, until canceled. You will be charged through your Apple account in accordance with Apple's billing procedures. Any applicable renewal notices, price-change notices, or requests for renewed consent will be provided as required by Apple policies and applicable law. Your purchase constitutes your express consent to the recurring charges and automatic-renewal terms disclosed at checkout.

5.3 Cancellation. You may cancel your subscription at any time through your Apple account's subscription management settings. To cancel on an Apple device, open Settings, select your Apple Account, select Subscriptions, choose Paydar, and follow the cancellation instructions. You may also manage subscriptions through Apple's subscription management website. Cancellation stops future renewals but generally does not refund a payment already processed. Unless otherwise required by applicable law or determined by Apple, your subscription benefits remain available through the end of the current paid billing period. Deleting the Paydar app or your Paydar account does not, by itself, cancel an active App Store subscription. You are responsible for confirming that your subscription has been canceled.

5.4 Refunds. Subscription fees are generally non-refundable, except where a refund is required by applicable law or approved by Apple. Apple controls the review and determination of refund requests for purchases made through the App Store. To request a refund, visit https://reportaproblem.apple.com, sign in with the Apple Account used for the purchase, select the applicable Paydar subscription, and follow the instructions. Submission of a refund request does not guarantee approval. Apple may approve or deny a request in accordance with its policies and applicable law. Canceling a subscription does not automatically initiate a refund, and requesting a refund does not necessarily cancel the subscription. You should separately confirm your subscription's renewal status. Nothing in these Terms limits any non-waivable rights or remedies available to you under applicable law.

5.5 Subscription Access and Changes. Subscription access is subject to the status of your subscription as reported by Apple and the applicable terms of your selected plan. If a subscription expires, is canceled, is refunded, or otherwise becomes inactive, access to associated premium features may end, subject to applicable law and any remaining entitlement period. Paydar may modify its subscription offerings, features, and pricing prospectively, subject to applicable law, required notices, and any consent required for continued billing at a changed price.

5.6 Separate Deal Payments. Subscription fees are separate from payments made or received through Paydar for athlete marketing agreements, brand campaigns, or other transactions between users. Subscription billing is administered through the Apple App Store. Any separate deal payments, payment-processing arrangements, and related refund or dispute procedures are governed by the terms applicable to those transactions and the relevant payment provider. Payment for a Paydar subscription does not guarantee access to any particular marketing opportunity, campaign, endorsement agreement, or financial outcome.

5.7 Consumer Rights. Nothing in this section is intended to waive, restrict, or exclude any right or remedy that cannot lawfully be waived, restricted, or excluded under applicable federal, state, or other applicable law.

6. Disputes Between Users, Intellectual Property & Termination

Disputes must be resolved in-app; Paydar reviews and determines fund release/refund outcomes, which are final. All software, branding, trademarks, designs, and scoring systems are owned by Paydar. Users retain rights to content they upload but grant Paydar a license to operate the service, display profiles, and process deals. Accounts may be suspended or terminated for violations, abuse, or fraud. Certain obligations (liability, indemnification) survive termination.

7. Disclaimers, Limitation of Liability, and Indemnification

Paydar provides all Services “as is” and disclaims all warranties, including with respect to AI output accuracy, uninterrupted service, and legal or regulatory compliance.

Limitation: Paydar’s total liability is limited to the greater of $500 or total fees paid within the prior 12 months.

Users (and Parents) agree to indemnify Paydar from claims arising from service use, contracts, processed payments, or minors’ actions.

8. Arbitration, Governing Law, Changes to Terms & Contact

Disputes are subject to binding arbitration under Delaware law, except as otherwise prohibited by law. No class action participation. Terms are governed by Delaware law. We may update Terms; continued use after notice constitutes acceptance.
